Iowa has sued OpenAI, accusing the ChatGPT maker of misleading parents and the public about how safe its chatbot is, and seven other states have filed their own lawsuits. Iowa Attorney General Brenna Bird announced the case on 14 October 2026.
These are allegations. No court has ruled on them.
Separate lawsuits, not one joint case
“A bipartisan group of states have also individually sued OpenAI,” Bird’s office said. The attorneys general of Kansas (Kris Kobach), Nebraska (Mike Hilgers) and West Virginia (JB McCuskey) joined Bird at her press conference. According to the release, “Arkansas, Arizona, Idaho and Montana have also sued OpenAI in their own state courts.”
Each state is suing separately under its own laws. Iowa is suing under the Iowa Consumer Fraud Act.
What Iowa alleges
“OpenAI is hurting kids and they are lying to Iowans,” Bird said. “OpenAI claims ChatGPT is safe while it’s giving dangerous medical advice, encouraging people to hurt others, and coaching people to commit suicide—all while pretending to be their fake friend.”
Iowa’s release alleges that ChatGPT is “designed to be overly agreeable and feign human compassion” and can be dangerous to vulnerable users such as children. The state wants to force OpenAI to comply with the Iowa Consumer Fraud Act and to stop what it calls dangerous activities.
OpenAI’s response
OpenAI spokesperson Drew Pusateri told SiliconANGLE that ChatGPT already has age-specific protections that “many other AI products lack”. “While no system can be perfect, we’ll continue to work with experts to inform our work and build additional safeguards, such as the parental controls, break reminders and age-appropriate model protections that exist today,” he said.
What this means
- Pressure on OpenAI is growing. Eight states are now suing over ChatGPT and children.
- Each case runs on its own. Separate suits in state courts could produce different results.
- Nothing is proven yet. The states’ claims will have to be tested in court.
